SwimToLearn terms & conditions
Swimtolearn Ltd terms and conditions apply to the contract to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by law, trade custom, practice or course of dealing.
1. Swim journey sessions
Our sessions are weekly and ongoing. Babies are allocated a session time and remain in the same session until they progress to the next level (or you request to change the time). At this point a different class is selected to accommodate and further their progression.
2. Private sessions
We offer a limited number of private sessions in Stage 1 and Stage 2. An overview of these services can be found on our website. Bookings for these and other Baby Spa services can be made online or please enquire via email.
3. Booking
Bookings for ‘The Journey’ and ‘Swim to Learn’ must be made via email. The swim ‘Journey’ runs until your baby is 7.5 months. Sessions are offered on an on-going basis. Should you decide to continue with ‘Swim to Learn’ lessons thereafter, these lessons are also provided on an on-going basis and run for 12 months.
‘The Journey’ package runs from Stage 1 (1-2 days old) and until your baby is 7.5 months, however, should your baby be older than 8 weeks the ‘Journey’ can commence from Stage 2.
After the Journey your baby graduates to ‘Swim to Learn’ (otherwise known as swimming lessons) for the rest of the year or when you decide to terminate sessions. The ‘Journey’ and ‘Swim to Learn’ classes are offered at an allocated day and time weekly. These sessions are both on-going and run for 12 months from September to the end of August the following year.
4. Payment
Fees for all on-going sessions are payable monthly in advance by Direct Debit. On-going sessions are calculated to cover 48 teaching weeks per year which allows for an average of 4 lessons per month. Direct Debits are collected on the 1st day of each calendar month or the first banking day thereafter. Should your direct debit be declined, 2 further attempts will be made to collect.
5. Direct debit
We use the online platform GoCardless for the collection of direct debits. Upon completion of your online registration, you will be prompted to set up your direct debit via GoCardless. Direct Debit applies to the ‘Journey’ and ‘Swim to Learn’ sessions only. Payments for other Baby Spa services are collected when bookings are made online.
6. Advance fees
These are for sessions received prior to your direct debit commencing.
7. Missed lesson allowance
All ‘Journey’ and ‘Swim to Learn’ registrations include 4 missed session allowances (or pro- rata) for each individual 12 month ‘Journey’ or ‘Swim to Learn’ registration. This means that for any session missed (up to a maximum of 4) your direct debit will be reduced to reflect the number of sessions you will not attend. This ‘allowance’ is primarily for sessions you cannot attend due to events, holidays and unforeseen circumstances. For sessions missed due to medical reasons, please refer to our illness clause no.16 within these terms and conditions.
It is not a requirement to use your missed session allowance but it must be noted that the allowance per individual ‘Journey’ and ‘Swim to Learn’ enrolment does not carry over to the next teaching calendar year, and any allowance not used will expire on the last teaching day in August. Missed session allowances can be transferred when progressing from the ‘Journey’ to ‘Swim to Learn’ but will have the same expiry of 12 months (or pro-rata).
This allowance is subject to the following conditions:
All missed allowances will be activated upon enrolment to the ‘Journey’ and ‘Swim to Learn’.
Allowances can be used as a four-week block, or the 4 lessons can be divided throughout the year between September to the last teaching day in August.
Each members’ individual allowance is pro-rated depending on when you start lesson in that year and can be rounded either up or down.
When an allowance request has been issued, it cannot be reversed and no exceptions can be made.
Allowances are for upcoming lessons only and cannot be backdated.
Allowance requests received before 15th of the month will be reflected in the following month's direct debit.
Allowance requests received after 15th of the month can be reflected up to 7 weeks later.
Your direct debit will then be reduced to reflect the number of lessons you will miss for each allowance request.
Allowance not used within the year cannot be rolled over to the following year, and will be forfeited.
Allowance cannot be used as or towards the 4-week cancellation notice period.
Our teaching calendar year runs from September to the end of August. Cancellations issued before the month of September will be subject to charges if excess missed lesson allowance has been taken.
8. Cancellation
4-week notice is required in writing via email for the cancellation of ‘Swim to Learn’ lessons. Once your cancellation has been received, we will respond by confirming the date of your last lesson and details of your final payment – if any. Should any fees be due, this amount will be collected via your existing direct debit. Once this final payment has been received, we will confirm cancellation of your membership via email and the receipt of the final payment as well as the proof of the cancellation of your direct debit. We ask that you do not cancel your direct debit before the receipt of our email. When a refund is due, we will request your bank details to process the refund. Please submit these as soon as you can as no refunds will be issued 8 weeks after the date of your cancellation.
9. Card payments
We accept most major debit and credit cards that are used for payment of some advance payments and other sessions or retail items. Payment for online sessions are made online and are subject to the relevant terms & conditions.
10. Lesson times
Please arrive early enough to change and prepare as punctuality is essential – latecomers disrupt lessons and may not be accepted into the class.
11. Class to be cancelled
Should the necessity arise for us to cancel due to unforeseen circumstance, we will give as much notice as possible and arrange for a make-up class. Your co-operation will be appreciated in this event so we can re-arrange to accommodate everyone. Make up lessons expire at the last lesson in August of that academic calendar year.
12. When you miss a lesson
We are under no obligation to offer make up classes for missed lessons due to minor illness. For anything more serious, allowances in the form of make-up classes may be considered. Please refer to our make-up policy (13) below for illness only. Please also refer to the missed lesson allowance clause 7 for missed lessons or if you plan to miss lessons for an extended period.
13. Make-up lesson policy for illness
In order for us to approve a make-up lesson for illness, we accept the following documents that must be dated and include the child’s full name;
Doctor’s note.
Copy of prescription or medication (named & dated).
Copy of child’s Personal Child Health Record detailing the illness.
Copy of clinical appointment letters.
Medical documentation must be submitted within two weeks of the missed lesson date.
Approved make-up lessons cannot be booked more than two weeks in advance.
This illness policy does not apply to sibling, parent or carer illnesses.
Please try to be flexible when arranging your approved make-up lesson.
Make-up lessons have an expiry of 8 weeks from the date of the missed lesson
Unscheduled make-up lessons expire on the last day of August each year.
Should you not attend your make-up lesson it cannot be rearranged.
Should you cancel your membership, any unarranged make-up lessons will be forfeited.
14. Infectious illnesses
Do not attend classes if your child suffering an infectious illness such as chicken pox, conjunctivitis, rotavirus, hand foot and mouth, impetigo etc. until the symptoms have cleared. Under no circumstances must anyone suffering from symptoms or occurrences of diarrhoea and vomiting attend swimming until they have been fully clear of these symptoms for at least 48 hours prior to your next lesson. Please note, pupils suffering from any of the above symptoms are not automatically eligible for a make-up lesson.
15. Nut-free zone
Please note that our premises are nut free zones. For the safety of our swimmers with nut allergies, we request that NO nuts or products containing nuts are brought or consumed on the premises.
16. Annual breaks
August end, Christmas and Easter (dates vary) are our standard club breaks. You are not charged for these periods. Please take note of the specific dates upon registration. These are also posted on our notice board. To maintain continuity, we do not break for half term.
17. Adverse weather
We are under no obligation to refund lessons missed due to a pool closure caused by adverse weather, likewise if you are unable to attend lessons due to adverse weather local to you while the pool remains open. We will make reasonable attempts to reschedule lessons should they be affected by adverse weather however this is not automatic and will take time to arrange.
18. Change of members details
Parents are responsible for the notification of any changes to their address, contact details, pupil’s health and/or condition and also if there is a change of care-giver. These changes and any other relevant changes should be made in writing and conveyed to the administration department. The security and care of our pupils is of paramount importance to us. Swimtolearn Ltd is GDPR compliant. Full details of our Privacy Policy and data protection can be found on our website.
19. Increase of costs
Swimtolearn Ltd reserves the right to increase costs. Swimtolearn Ltd will give sufficient notice in advance.
20. Communication
For last minute changes that affect many customers, Swimtolearn will communicate mainly via email as well as email blast from our database. This correspondence may land in your junk/spam box. Please check your junk/spam mailbox regularly to avoid missing any important correspondence from us.
21. Reserving the right to change these terms & conditions
We reserve the right to change or add to these terms and conditions for legal, safety or other substantive reasons or in order to assist the proper delivery of tuition at our club. We will send you notice of any such modifications at least one month in advance before any modifications are applied.
22. Insurance
For insurance reasons, failure to agree to and submit our terms and conditions prior to your first lesson means your child will not be able to attend his/her first lesson or any lesson thereafter until the terms and conditions have been received. As a specific class will have been allocated for your child, fees will still be due in the event the terms and conditions have not been submitted.
23. Accompanying adults
Strictly children are not to be left unattended at any time. ‘Journey’ parents are to remain with their baby for every session. Outside of their swimming lessons all ‘Swim to Learn’ pupils are the sole responsibility of the parent or carer. Parents or carers must not leave the premises during their child’s lesson. We ask that all children are accompanied when visiting the toilet unless they are capable of this on their own.
24. Personal property
Parents/Carers are responsible for the security and safe use of all personal property including money, mobile phones, keys, watches, computers etc. and Swimtolearn Ltd shall not be responsible for any loss of or damage to any such property.
25. Notices
News, general and specific notices are displayed throughout the teaching facilities and/or are emailed to members. It is important that you read and make yourself aware of these notices for health and safety reasons as well as for the efficient running of the premises.
26. Accident and injury
In the event of an accident, an accident report form (available at reception) must be completed and signed by a parent/guardian as well as the teacher – should the accident happen in the pool. Swimtolearn Ltd staff hold general & paediatric first aid certifications and take every precaution in the protection and safeguarding of all club members. Safety Notices are prominently displayed throughout the facility, please take note of these and ask any of your visitors to do the same. Should you come across any hazard or danger, please report it to reception immediately.
27. Visitors
Siblings or any other children under the age of 6 years are not permitted to attend Baby Spa sessions.
28. Video and photography
Video and photography are not permitted during ‘Journey’ sessions and ‘Swim to Learn’ sessions without prior permission.
29. Complaints procedure
A complaint about any matters relating to Swimtolearn Ltd, its policies or administration should be directed in writing to the administration department via our contact form. Any reasonable complaint shall receive fair and proper consideration.
30. Photographs, images and promotional material
It is the custom and practice of Swimtolearn Ltd. to include some photographs or images of pupils in our promotional material, social media, website or to publicise events and the achievements of our pupils. These images may be taken in and around the swim school and will not be used by Swimtolearn Ltd for any other purpose. We will never include the names and ages of the pupil without prior consent from the parents. If you do not consent for your child to be photographed you can ‘opt out’. Simply send us an email stating your request to ‘opt out’. We will respond by acknowledging your request.
31. Safeguarding policy
Swimtolearn Ltd are committed to providing a safe and positive environment for all our pupils and take all necessary steps to ensure that good practice procedures at our clubs are adhered to. Our full safeguarding policy can be viewed on our website. A copy is also held and can be viewed at your club.
32. Club attendance procedures, general rules and pool rules
Please take note of the following procedures that have been written with your health and your child’s health and safety in mind;
32.1. Pool area
DO NOT enter the pool area at any time or before the start of your lesson if there is no instructor present.
32.2. Changing facilities
Dedicated change areas for mothers and fathers with babies are available. Please store your belongings in the plastic boxes provided and leave the changing tops clear and ready for the next pupil. No food is permitted in the pool changing area or the spa and neonate room.
32.3. Shoes
For health and safety reasons and to avoid water contamination everyone is required to remove street shoes before passing through reception. Please use the shoe storage available in the reception area and do not allow your shoes to obstruct any of the entrances or thoroughfare. Please also ensure you leave our premises with the correct pair of shoes.
32.4. Baby change mat system for hygiene
Please ensure you spray and wipe baby change mat, after use, with the disinfectant supplied to ensure necessary hygiene measures are met for our little swimmers.
32.5. Nappies
Please make use of these and discard them in the appropriate bins.
32.6. Towels
Towels are supplied for the stages 1 and 2 and the Baby Bonding sessions however please supply your towels for all other sessions.
32.7. Lost property
We cannot be held responsible for any damage, loss or theft of personal property. The facility is equipped with Lost Property bags so please ask reception if you think you have lost something on our premises. Any items not claimed within one month will be donated to charity.
32.8. Waiting areas
For the comfort of everyone we ask all visitors, carers and pupils to keep noise levels to a minimum.
32.9. Swim session
Duration of all swimming pool sessions is 30 minutes.
32.10. Sessions
We allow an hour for Stage 1, Stage 2 and Bonding with Baby sessions although the duration of the session will be determined by your baby’s tolerance and progression.
32.11. Massage
Our therapists demonstrate baby massage techniques and encourage parents and care givers to apply baby massage to their babies on a regular basis. Parents are at liberty to massage their babies themselves after the sessions.
32.12. Questions and queries
For general questions and queries please speak to reception. For lesson queries and pupil progress updates and or concerns, please direct these in writing to the club manager concerned. It is important that instructors are not disturbed or interrupted at the poolside.
32.13. Swimwear
For health and safety reasons, all babies must wear two layers – swim nappies covered with a fitted swimming costume.
32.14. Hygiene
To ensure that a high standard of water hygiene is maintained, all babies and accompanying adults must shower before entering the pool.
32.15. Showering and water
Water is precious so please be respectful of the use of water and keep showers short.
32.16. Toilet facilities
All children must be accompanied by an adult when visiting the toilet facilities even if they are able to do so independently. Pupils are required to visit the toilet before commencement of lessons.
32.17. Facilities
Please leave the rooms, as you would like to find them. Please ensure nappies are discarded in the appropriate bins.
32.18. Watching
Lessons can be observed through the viewing area at reception.
32.19. Baby seats
We have supplied baby seats for the convenience of parents to safe-guard their babies while they are changing. No extra person, other than the pupil and adult going into the pool with the pupil may enter the change area.
32.20. Private sessions
During ‘Bonding with Baby sessions’ both parents enter the pool with their baby.
32.21. Questions and queries
For general questions and queries please speak to reception. For pupil progress updates and or concerns, please email us. Instructors should not be interrupted at the poolside.
33. Waiver
A waiver of any right or remedy under the contract or by law is only effective if given in writing and shall not be deemed a waiver of any subsequent right or remedy. A failure or delay by Swimtolearn Ltd to exercise any right or remedy provided under the contract or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under the contract or by law shall prevent or restrict the further exercise of that or any other right or remedy.
34. Third party rights
Unless it expressly states otherwise, the Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
35. Governing law
The contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
36. Jurisdiction
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the contract or its subject matter or formation.
Any diversion from the above terms and conditions are gestures of goodwill on the part of Swimtolearn Ltd. Right of Admission is reserved.
By attending my scheduled classes, I hereby confirm that I have read, understood and agree to the above terms and conditions, attendance procedures and pool rules.
