Website & Booking Terms and Conditions (“Terms”) September 2022

1. Definitions

1.1. In these Terms the following words shall have the following meanings:

“Baby Spa” the trading name of Swimtolearn Limited, a company incorporated in England and Wales under company number 13458065 whose registered office is at 11 Wilson Walk, off Prebend Gardens, Stamford Brook, London W4 1TP; VAT registration number: 405 9678 68. Baby Spa premises at 74a Sterndale Road, London W14 0HX provides neonatal hydrotherapy, infant massage and parent baby pre-booked swim sessions;

1.2.  The headings in these Terms are for convenience only and shall not affect their interpretation.

1.3.  Words in the singular include the plural and vice versa.

2. Access and Information about you

2.1 Access to this website is provided on a temporary basis and we reserve the right to withdraw or amend the whole or any part of the website at any time without notice and without incurring any liability. From time to time we may restrict access to some parts or all of the website to all users.

2.2 Any use of this website or any materials provided on it other than in accordance with these Terms of Use is prohibited. If you breach these Terms of Use, your permission to use the website terminates automatically and you must immediately destroy any downloaded or printed extracts from the website.

2.3 Please see our Privacy Policy for details about what information we collect and how we will use and protect it. By using the website, you consent to such information processing and warrant that all data provided by you is accurate.

3. Registration

3.1 You will be able to access most areas of this website without registering your details with us. You may however be offered the opportunity to subscribe and/or register to receive additional website or information. We are not under any obligation to accept a request for registration or subscription and reserve the right to suspend or cancel your registration or terminate access at any time for any reason.

3.2 Each registration is for a single user only.  If you subscribe to any email services (such as newsletters) your use of the content received through the email service will be subject to these Terms of Use.

4. Services with us 

4.1 Baby Spa services provided are subject to the Terms and Conditions below which should also be read carefully.

4.2 Bookings can be placed through the website and in person at 74a Sterndale Road, Brook Green, London, W14 0HX.

4.3 All attendees are required to complete a registration form prior to their first session.  Sessions cannot commence without registration; please leave adequate time before your first session to complete the form. 

4.4 All Stage 1 & 2 sessions are allocated up to 1 hour.  Some babies cannot tolerate a full hour.  In this case, the session will be shortened in line with the individual baby’s capacity and no refund provided.

4.5 Parents / Carers are responsible for the security and safe use of all personal property including money, mobile phones, keys, watches, computers, etc. Baby Spa shall not be responsible for any loss of or damage to any such property.

4.6 It is the custom and practice of Baby Spa to include some photographs or images of pupils in our promotional material, social media, website or to publicise events and the achievements of our pupils. These images may be taken in and around the facilities and will not be used by Baby Spa for any other purpose.  You will be asked upon registration to ‘opt in’ to allow your baby to be photographed. 

4.7 Baby Spa are committed to providing a safe and positive environment for all and take any and all necessary steps to ensure that good practice procedures at our facility.

5. Ownership of website materials and licence terms

5.1 We are the owner or licensee of all intellectual property rights in the Website and in the material published on it. Those works are protected by laws and treaties around the world. All such rights are reserved.

5.2 No photographs in the website may be reproduced for any purpose.

6. Accuracy of information 

6.1 We take care to ensure that the information on the website is accurate and up to date. However, it may occasionally be inaccurate or out of date. We have no liability for any inaccurate information and reserve the right to correct it at any time.

7. Applicable law and jurisdiction

7.1 These Terms of Use and the Privacy Policy and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.

7.2 Under these Terms of Use and the Privacy Policy the English courts will have jurisdiction over any claim arising from, or related to, the Terms of Use and the Privacy Policy, including, for the avoidance of any doubt any dispute involving the use of your data under the Privacy Policy.

8. Variation

8.1 We reserve the right to change these Terms of Use at any time. The new version will be posted on the website and will take effect immediately upon posting. If you use the website after the new Terms of Use have come into effect any further use of the Website indicates your agreement to be bound by the new Terms of Use. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on the Website. 

9. eCommerce terms and conditions

9.1 Placing an order / Booking - You are deemed to place an order / book with us by ordering / booking via our online checkout process. As part of our checkout process, you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products / booking you have ordered / ordered.

9.2 We may refuse to accept an order / booking:

(a) where goods and or services are not available;

(b) where we cannot obtain authorisation for your payment; or

(c) if there has been a pricing or product description error.

9.3 Full payment for booking is required in order to complete the online checkout process.

9.4 Please ensure you state the correct age of your baby. Babies deemed to be older than stated will be refused attendance for the type of session purchased.

9.5  Packages of 5 sessions purchased must be used within 7 weeks (49 days) from the date of purchase.

9.6  Packages of 10 sessions purchased must be used within 12 weeks (84 days) from the date of purchase.

9.7 A voucher code will be issued for all Gift Certificates purchased that must be redeemed for the number of sessions stated on the voucher and within the time period specified in clause 9.7 below.

9.8  No refunds will be issued for unused or partly used Gift Certificates.

9.9  Gift Certificates have an expiry date of 120 days from the babies’ date of birth ‘or’ an age limit of 8 weeks (Stage 1) or 4 months (Stage 2).  Baby Spa is not obliged to extend the expiry term. 

10. Promotional codes

10.1 Only one promotional code can be redeemed per order.

10.2 The addition of the promotional code will automatically add benefit to your basket or apply a discount depending on the offer.

10.3 We cannot amend any promotional orders once they have been processed.

10.4 Any offers are subject to availability and may be withdrawn or amended without notice. Any offers have no cash alternatives.

11. Pricing

11.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

12. Rescheduling policy

12.1 In respect of single purchased sessions, Baby Spa allows you the right to reschedule your booking directly with Baby Spa or via their website within 48 hours the original session time.  This will ensure your booking is not lost.

12.2  For bookings forming part of a package, you have the right to reschedule a session providing you rebook within 24 hours of the original session time.  No refunds are provided for sessions booked as part of a package and all sessions must be rebooked within the time periods specified in clauses 9.5 and 9.6 above.

12.3. Baby Spa is not obliged to refund or provide an alternative session if you cancel or miss your session.

13. Goods return policy

13.1 We will be more than happy to offer a refund for any goods purchased providing it is returned to us with the receipt of purchase, in their original and undamaged packaging, with tags intact.

13.2  Please note that we will only be able to offer a refund if the above conditions are met and failure to comply will result in a delayed or unfulfilled refund.

13.3 Upon receipt of the goods we will give you a full refund of the amount paid.
